LESTER TAROFF

Mr. Taroff has been in practice for over 30 years. He graduated from Long Island University in 1968, attended Brooklyn Law School, and graduated in 1971. He was then admitted to the New York State Bar in 1972.

Mr. Taroff concentrates his practice in the following areas: Creditors’ Rights; Commercial and Retail; Commercial Litigation and Judgment Enforcement.

Mr. Taroff is a frequent lecturer on the subject of creditors’ rights, and is active in several law associations and organizations. He serves as co-chair of the Creditors Rights Law Committee of the Suffolk County Bar Association, is the Vice President of the Commerical Lawyers Conference of New York and serves on the Global Debt Collection Summitt Advisory Board.

PRACTICE AREAS

Creditors' Rights

BANKRUPTCY

We represent creditors in bankruptcy matters, including filing proofs of claim, debtor’s exams, defending actions to void judgments or other liens, and defending claims or actions alleging preferential payments or transfers.

CONSTRUCTION

We represent creditors in construction-related claims, from collection of receivables to notification, filing and enforcement of materialmen’s liens and state or Federal bond claims.

INSURANCE PREMIUM

We collect outstanding insurance premium receivables on commercial liability, workers’ compensation or other policies, for collection of premiums due, audit claims, short rate claims, and any other premium due claims.

LANDLORD & TENNANT/REPOSSESSION

We can commence actions to evict a tenant who has breached a rental agreement by failing to make timely payments as well as any other breach of the agreement. We can obtain possession of the property for the creditor & collect any money owed under the rental agreement as well as any damages.

PROPERTY FORECLOSURE/REPLEVIN

We pursue the remedies available to a creditor with a lien or right of possession to personal property through the means provided under the UCC and state law - including repossession and replevin actions.

REAL ESTATE FORECLOSURE

We can commence foreclosure action on real estate owned by the debtor to sell the realty, purchase at foreclosure and/or protect any deficiency balance, place and enforce judgment liens, or take action to protect the creditor's interest where the foreclosure is initiated by another party on real estate on which the creditor has a lien.



RETAIL COLLECTIONS

We pursue claims for creditors against individual consumers for debts incurred for family or household purposes, as governed by the Fair Debt Collection Practices Act.

SECURED TRANSACTION/LEASING

We assist creditors in filing U.C.C. liens in order to obtain a priority position & also assist creditors in enforcing those liens & recovering their collateral and deficiency balances. Additionally, we draft or review Lease Agreements as well as collect any money owed on a breached Lease Agreement, in addition to recovering the merchandise when appropriate.



SUBROGATION CLAIMS

We pursue claims where rights have been assigned to third parties, usually an insurance company, to pursue reimbursement for payments made to an insured when the insured is not at fault.

TRANSPORTATION CLAIMS

We collect outstanding claims for carriage of freight, including claims involving the Interstate commerce Commission rules and tariffs, as well as transport of goods under Bill of Lading.
