Comment Period Open for Proposed Changes to Federal Rules

On August 15, the Judicial Conference of the U.S. Advisory Committee on Bankruptcy Rules announced proposed amendments to the Federal Rules of Bankruptcy Procedure and Official Forms.  

Changes are proposed to the following:   

Bankruptcy Rules 1014, Dismissal and Change of Venue, 7004, 7008, 7012, 7016, 7054, 8001-8028, 9023-9024, 9027, and 9033, and Official Forms 3A, 3B, 6I, 6J, 22A-1, 22A-2, 22B, 22C-1, and 22C-2, which includes the “means test” forms.  Changes were also proposed to Appellate Rule 6, concerning appeals to the court of appeals in a bankruptcy case.

All comments must be submitted by February 15, 2013 and can be submitted to rules_comments@uscourts.gov or the Committee on Rules of Practice and Procedures, Administrative Office of the US Courts, Suite 7-240, Washington, DC 20544.   The public hearing will be held in Chicago on Jan. 18, 2013 and in Washington, DC on Feb. 1, 2013.  All wishing to testify must notify the Committee in writing at least 30 days before the hearing.
